1. Introduction
This Manual is published in terms of section 51 of the Promotion of Access to Information Act, 2000 (PAIA). It explains how a member of the public may request access to records held by Enerthia Energy (Pty) Ltd (“Enerthia”), and the records we hold.
PAIA gives effect to the constitutional right of access to information held by public and private bodies, where access is required for the exercise or protection of any right.

- Channel Partner Agreements, Service Agreements, Endorsement Agreements, NDAs

6. How to request access to a record
A request for access to a record must be made on the prescribed PAIA Form 02 (available from the Information Regulator’s website) and sent to the Information Officer at vanessa.mann@enerthiaenergy.co.za.
The request must:
- Identify the record sought with sufficient particularity.
- State the form of access required.
- State the right the requester is seeking to exercise or protect, and the reason the record is required.
- Include the prescribed fee where applicable.
7. Fees
Fees prescribed under PAIA may apply. Current fees are set out in the regulations published by the Information Regulator and on https://inforegulator.org.za.
8. Grounds for refusal
Enerthia may refuse access to a record on the grounds set out in Chapter 4 of PAIA, including:
- Protection of personal information of third parties (section 63).
- Protection of commercial information of third parties (section 64).
- Protection of confidential information of third parties (section 65).
- Protection of records privileged from production in legal proceedings (section 67).
- Protection of commercial information of Enerthia (section 68).
- Protection of research information (section 69).
9. Remedies available if a request is refused
If your request is refused, or you are dissatisfied with the response, you may:
- Submit a complaint to the Information Regulator (PAIAComplaints@inforegulator.org.za).
- Apply to a court of competent jurisdiction for appropriate relief.
10. Updates to this Manual
This Manual will be updated when there is a material change to the records held or the Information Officer designated. The “Effective date” at the top reflects the most recent revision.
