Enerthia Energy (Pty) Ltd (“Enerthia”, “we”, “us”, “our”) respects your privacy and is committed to protecting your personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA).

This Privacy Policy explains what personal information we collect through our website enerthiaenergy.co.za, why we collect it, how we use it, who we share it with, how long we retain it, and the rights you have under POPIA.

What personal information we collect

We collect the following categories of personal information:

  • Contact form submissions — name, email address, phone number, and any message content you provide via our website contact form.
  • Newsletter subscriptions — email address (and any optional details you choose to share) submitted via our subscribe form.
  • Website analytics — anonymised technical data collected by Google Analytics 4, including IP address (anonymised), browser type, device type, pages visited, referral source, and approximate location. We use this data in aggregate to understand how visitors use our site.
  • Cookies — small data files placed on your device to enable site functionality and analytics. See our Cookie Policy for full detail.
  • Direct correspondence — information you choose to share when you email, call, or WhatsApp us.

Why we collect it (purpose)

We collect personal information only for the following defined purposes:

  • To respond to enquiries submitted via our website, email, phone, or WhatsApp.
  • To send newsletter communications to people who have explicitly opted in (double opt-in via MailerLite).
  • To understand how our website is used and improve it.
  • To comply with applicable laws and regulations.
  • To establish, exercise, or defend legal claims where necessary.

Legal basis for processing

We rely on the following lawful bases under POPIA section 11:

  • Consent — for newsletter subscriptions and non-essential cookies (analytics).
  • Performance of a contract or pre-contractual steps — when you contact us to enquire about our services.
  • Legitimate interests — for essential website operation, security, and fraud prevention.
  • Legal obligation — where we are required to retain or disclose information by law.

Who we share it with (third-party processors)

We share personal information only with the third-party operators necessary to deliver our services. Each is bound by data protection obligations:

  • MailerLite (newsletter platform) — stores subscriber email addresses and manages opt-in confirmation and unsubscribe requests. MailerLite is GDPR and POPIA compliant. Privacy policy: mailerlite.com/legal/privacy-policy
  • WPForms (contact form processor) — temporarily processes form submissions before delivery to our email inbox.
  • domains.co.za (hosting and email provider) — hosts our website, email, and database in South African data centres.
  • Google Analytics 4 (Google LLC, analytics provider) — processes anonymised website usage data. Privacy policy: policies.google.com/privacy

We do not sell, rent, or trade your personal information to any third party for marketing purposes.

Cross-border transfers

Some of our processors (notably MailerLite and Google) store data outside South Africa. Where this occurs, we ensure adequate protection through the processor’s published safeguards and POPIA section 72 compliance.

How long we retain personal information

  • Contact form submissions — 24 months from submission, then deleted, unless an active engagement requires longer retention.
  • Newsletter subscribers — retained until you unsubscribe; unsubscribe requests are honoured immediately.
  • Website analytics data — retained per Google Analytics 4 default settings (currently 14 months) at aggregated level.
  • Email correspondence — retained as long as needed for the business purpose, then archived or deleted in line with our internal retention schedule.
  • Backups — full website backups retained for up to 90 days, then overwritten.

Your rights under POPIA

You have the right to:

  • Confirm whether we hold personal information about you.
  • Request access to that information.
  • Request correction, deletion, or destruction of inaccurate, misleading, or no-longer-needed information.
  • Object to the processing of your personal information.
  • Withdraw consent at any time (where consent is the legal basis).
  • Lodge a complaint with the Information Regulator (see below).

Security

We take appropriate technical and organisational measures to protect your personal information against loss, misuse, unauthorised access, alteration, or destruction. These include HTTPS encryption on our website, secure hosting, access controls, and regular software updates.

In the event of a security compromise that materially affects your personal information, we will notify you and the Information Regulator as required by POPIA section 22.

Direct marketing

We send marketing communications (newsletters, service updates) only with your explicit opt-in consent. Every marketing email contains an unsubscribe link. You may withdraw consent at any time.

Children

Our website and services are not directed at children under 18. We do not knowingly collect personal information from children.

If you believe we have not handled your personal information in accordance with POPIA, you have the right to lodge a complaint with the Information Regulator:
